“Essentially, Brenda,” says Steve, “probate is a legal process that takes place after someone passes away. It involves validating their will (if there is one), identifying and inventorying their assets, paying off debts and taxes, and ultimately distributing the remaining property to heirs or beneficiaries.”
Navigating the Probate Process: Handling Debts and Taxes
Steve, you mentioned paying off debts and taxes. Can you elaborate on that step? It seems like it could be a complicated aspect of probate.
“You’re right, Brenda,” Steve acknowledges. “Handling debts and taxes is a crucial part of the probate process. Ordinarily, this involves identifying all valid creditor claims against the estate. Creditors have a limited time to file these claims with the court. Once these claims are assessed and verified, they must be paid off using funds from the estate.”
He continues, “It’s important to note that taxes also need to be addressed during probate. This can include federal estate taxes, as well as state-level inheritance or death taxes. The specific tax implications will vary depending on the size and composition of the estate.”
Steve shares a story about a client whose loved one had left behind significant credit card debt. “It turned out that many of these charges were fraudulent,” he explains. “Working with the credit card companies, we were able to successfully dispute those charges and significantly reduce the amount owed by the estate.”
The American Bar Association reports that approximately 2 million people die each year in the United States, leaving behind estates that often require probate.
