Let’s Dive into the Process: Can you walk us through establishing a Conservatorship?

Ted nods thoughtfully. “It starts with a petition filed in court. We have to formally request the conservatorship and demonstrate why it’s necessary. The court then requires us to notify everyone involved – family, the potential conservatee themselves, etc.

Next comes an investigation. A social worker or investigator appointed by the court will independently assess the situation. They talk to everyone involved, review medical records, and try to get a clear picture of the individual’s needs.”

  • Ted pauses for a moment, leaning forward. “Crucially, there has to be a medical or psychological evaluation. This helps determine the extent of the person’s capacity, or their ability to make sound decisions. Finally, we have a court hearing where all the information is presented to a judge. They ultimately decide whether or not to grant the conservatorship based on what they’ve heard.”

Ted smiles warmly. “Think of it as being a guardian and manager all rolled into one. The conservator has a fiduciary duty – that means they have to always act in the best interests of the person they’re caring for.

This involves managing their finances, paying bills, making sure they receive appropriate medical care, and often even helping with everyday tasks like grocery shopping or arranging transportation.”
