Interview with Steve Bliss

Setting the Stage

Welcome back to “San Diego Legal Beat.” I’m your host, Maria Sanchez, and today we have the pleasure of speaking with renowned San Diego Probate Attorney, Steve Bliss. Steve, thank you for joining us.

Probate: A Necessary Process

Steve, can you shed some light on one of the most crucial steps in estate planning – probate? What exactly is it and why is it so important?

The Importance of Handling Debts and Taxes

Steve explains, “Probate isn’t always a joyful process, but it’s often necessary to ensure that an individual’s assets are distributed according to their wishes. One crucial step within probate involves handling debts and taxes. This entails meticulously identifying and paying all valid creditor claims against the estate.” He continues, “ordinarily, this would involve reviewing financial records, contacting creditors, and ensuring timely payments. Moreover, we also have to navigate the complexities of filing and paying any applicable state or federal taxes.

Consequently, failing to address these financial obligations can lead to complications down the line, potentially delaying the distribution of assets to beneficiaries. This is why it’s essential to work with an experienced probate attorney who understands the intricacies of this process.” Steve pauses thoughtfully. “Remember,” he emphasizes, “over 70% of estates go through some form of probate according to a recent study by the American Bar Association, highlighting its prevalence in estate administration.”

I remember one case, where the deceased individual hadn’t kept meticulous financial records, making it difficult to identify and contact all creditors. It took considerable effort and detective work to track down everyone who was owed money. Nevertheless, we were able to resolve all outstanding debts and ensure that the estate was distributed fairly according to the will.”

Seeking Expert Guidance

Steve concludes, “Probate can be a complex process with numerous legal and financial considerations. I strongly advise anyone facing probate to consult with an experienced attorney who can guide them through each step, ensuring that their loved one’s final wishes are honored while complying with all applicable laws.”
